Overview of the Team
The Statutory Oversight team is responsible for providing expert advice on the application of statutory processes to business areas within Comcare and acts as Comcare’s liaison with the Office of Australian Information Commissioner and the Commonwealth Ombudsman.
Statutory Oversight actively promotes Privacy and develops Comcare-wide privacy training and is responsible for ensuring Privacy Impact Assessments are completed and that Comcare’s activities are consistent with the Privacy Act 1988.
The team is responsible for undertaking all of Comcare’s freedom of information functions as well as receiving Public Interest Disclosures (PID) and co-ordinating PID investigations.
The team also facilitates administrative access to personal information under the statutory requirements in the Safety, Rehabilitation and Compensation Act 1988 (SRC Act).
Overview of the Role
The Legal Adviser works closely with the Senior Legal Adviser in performing their role and provides client-focused high level, specialist legal and strategic advice and support to Comcare staff to ensure compliance with statutory obligations.
Legal Advisers are responsible for managing a case load of various requests including:
- Providing advice on administrative law matters including FOI and privacy and undertaking administrative decision making,
- Ad-hoc matters and administration tasks assist the team, Senior Legal Adviser and Director, and
- Legal Advisers may also manage a small team.
Mandatory Qualifications and Experience
- Undergraduate degree in law.
- Admission as a legal practitioner of the High Court or the Supreme Court of an Australian State or Territory (two years or more post admission experience is desirable).
- Current Practising Certificate.
Eligibility and Specific Conditions of Employment
- Australian citizenship.
- Character clearance (Australian Criminal History Check).
- Employee Health Declaration.
- Six months probationary period for new engagements.
